Art. 81 ff. EGV“.
Einleitend folgt eine kurze Umschreibung des Wettbewerbsbegriffes, da dieser eine zentrale Rolle im Wettbewerbs- und Kartellrecht spielt.
Um den Rahmen dieser Ausarbeitung nicht zu sprengen habe ich mich auf die in meinen Augen wichtigsten Teile der ARTIKEL 81 – 89 beschränkt. Wettbewerb oder Konkurrenz ist volkswirtschaftlich der Leistungskampf zwischen unabhängigen Wirtschaftseinheiten am Markt. Anbieter versuchen möglichst vorteilhaft zu Lasten ihrer Konkurrenten Waren und Dienstleistungen zu verkaufen1. Umgekehrt versuchen Nachfrager möglichst günstig zu kaufen. Dadurch kommt es unter marktwirtschaftlichen Bedingungen zu einer Selektion der besten Produkte zu den günstigsten Preisen.

Wettbewerb ist daher das in einer Marktwirtschaft dominierende Verfahren zur Lösung des Problems, was, wie und für wen produziert werden soll. Gablers Wirtschaftslexikon spricht in diesem Zusammenhang unter anderem von einer Verteilungsfunktion. Charakterisiert ist die Verteilungsfunktion dadurch, dass Einkommen entsprechend der Wettbewerbsfähigkeit eines Unternehmens und damit entsprechend seinem Leistungsvermögen verteilt werden.
Zusätzlich kann bei Wettbewerb von Konsumentensouveränität gekoppelt mit einer optimalen Faktorallokation gesprochen werden: Hierbei wird die Zusammensetzung des Güterangebots nach den Präferenzen der Konsumenten bestimmt sowie die Lenkung der Produktionsfaktoren in effiziente Verwendungen.
