Für den weiteren Verlauf ist es allerdings notwendig, den Begriff „Abfall“ genauer fest zulegen. Angrenzend zur ökologischen Perspektive werden in dieser Referatsausarbeitung überwiegend juristische und ökonomische Aspekte betrachtet.
Die Beseitigung von Abfällen ist oft mit hohen Kosten verbunden, nicht zuletzt aus diesem Grund suchen die betreffenden Personen nach „günstigeren“ Alternativen. Diese Kosten liegen unter anderem in der Flächenbeanspruchung von Anlagen, ihrem Kapital- und Arbeitskräftebedarf und der verbleibenden Umweltbelastung begründet. Eine Lösung dieses Problems sehen die Betroffenen in der Umdeklarierung von Abfall in sekundäre Rohstoffe. Daraus resultiert ein neues Problem, nämlich das der Abgrenzung zwischen Abfall und Ware.
Im nächsten Abschnitt gilt es diesen Kreislauf zwischen den Akteuren, den Konsumenten und der Rolle der Wirtschaft den sie in dem Sektor Abfallwirtschaft innehaben darzustellen. Im Vordergrund dabei steht nicht die Schuldzuweisung, sondern vielmehr die Darlegung des Problems „Warenaspekte“. In den darauffolgenden Teilen sollen vor allem die ökonomischen Aspekte des Abfallrechts Beachtung finden.
Ein wesentlicher Grund warum der Verfasser und auch andere sich mit der Thematik Abfallwirtschaft befassen, ist, dass Abfallwirtschaft profitabel geworden ist und eine Lobby für Abfallvermeidung fehlt. Es ist zu teuer und keiner kann es sich mehr leisten, sich nicht mit dem Problem „Abfall“ auseinander zu setzen.
