von der öffentlichen Hand, wie auch durch Private zur Verfügung gestellt werden,
unterliegen immer öfter den Kosteneinsparungsprogrammen der Verantwortlichen. Die
Kulturfinanzierung in Deutschland steckt in einer ihrer schwersten Krisen, die sie
jemals erlebt hat.
Der Hauptteil der Kulturfinanzierung in Deutschland wird aus staatlichen und
kommunalen Mitteln bestritten. Nach Angaben von Hummel beliefen sich die Ausgaben
der öffentlichen Hand für die Kunst– und Kulturpflege im Jahre 1988 auf 10,5 Mrd.
DM.1 Das Engagement des Staates reicht von der kulturellen Ausbildung an Akademien
und Hochschulen, über die Trägerschaft von Musikschulen, Theatern, Museen und
Bibliotheken, bis hin zur Vergabe von Stipendien und Zuschüssen an örtliche
Musikvereine. Eine derartig großzügige Kulturfinanzierung aus öffentlichen Mitteln in
Deutschland ist politisch gewollt.2 Das sich Deutschland als eine Kulturgesellschaft
versteht, ist nicht zuletzt aus der im Grundgesetz, Art. 5 Abs. 3 enthaltenen
Kunstfreiheitsgarantie –„Die Kunst und Wissenschaft, Forschung und Lehre sind frei“ –
ersichtlich. Dieser Artikel des GG „ ... dient als Bezugspunkt für die Annahme eines
bestehenden Grundkonsenses darüber, daß Kunst der Allgemeinheit dient.“ 3 Die
Kulturzuständigkeiten und damit die Kulturförderungsaufgaben sind nach der
föderativen Struktur in Deutschland in den einzelnen Landesverfassungen verankert.4
Wenn also die Notwendigkeit durch den Staat gesehen wird, eine öffentliche
Kulturförderung zu betreiben, so kann die Frage, die das Thema beinhaltet – „Kultur
eine öffentliche Aufgabe?“ - bereits an dieser Stelle grundsätzlich bejaht werden.
Da Kultur vom Staat offenbar als öffentliche Aufgabe verstanden wird, soll im
Folgendem Kapitel 2 die Legitimation einer staatlichen Kulturförderung überprüft
werden. Hierzu wird der besondere Gutcharakter der Kultur untersucht und
anschließend bewertet. In Kapitel 3 werden dann Möglichkeiten zur Kulturfinanzierung diskutiert. Dabei erstrecken sich die Untersuchungen von einer Bertachtung der
staatlichen Kulturfinanzierung, über eine Komplementärfinanzierung zwischen Staat
und privater Seite, bis hin zu einer rein privaten Kulturfinanzierung. Den Abschluß der
Arbeit bildet die Zusammenfassung im Kapitel 4.
