Der Bildjournalismus ist in den Bereich der Medien einzuordnen und wird insbesondere von der Presse, dem Internet und dem Fernsehen genutzt. Wir befinden uns in einem Zeitalter der Visualisierung der Kommunikation, in dem das Bild eine entscheidende Rolle einnimmt und nicht selten als wichtiger angesehen wird als das geschriebene oder das gesprochene Wort. Die Publikation eines Fotos hat häufig eine deutlich größere Wirkung auf den Betrachter und einen größeren Erinnerungseffekt als eine verbale Darstellung eines bestimmten Ereignisses. In der heutigen Informations- und Mediengesellschaft werden die unterschiedlichsten Persönlichkeitsmerkmale von Personen, v.a. denen des öffentlichen Lebens, wie deren Bildnis oder deren Name teils ohne Skrupel und Rücksicht auf die Persönlichkeitsrechte der Abgebildeten zu deren Lebzeiten und auch danach zu Werbezwecken oder Auflagensteigerungen ausgenutzt. Somit stellt sich immer wieder das Problem der Verletzung des Persönlichkeitsrechts, welches zu Beginn dieser Seminararbeit einführend erläutert werden soll. In seinen Anfängen war die praktische Bedeutung des Rechts am eigenen Bild auf Fotos von Personen im öffentlichen Leben, Fotos zu Werbezwecken oder auf in Zeitungen, Zeitschriften sowie dem Fernsehen veröffentlichten Bildnissen beschränkt. Vor allem die enormen technischen Entwicklungen, besonders im Bereich der Digitalfotografie und der Filmkameras, sowie der Erfindung von Fotohandys und der Entstehung des Internets, welches jedem jederzeit die Möglichkeit zur Veröffentlichung von Bildern bietet, haben zu einer nie da gewesenen Bilderflut und einer damit einhergehenden Fülle an Rechtsverletzungen geführt, die nunmehr weite Kreise der Bevölkerung betrifft. Einen Schutz gegen derartige Persönlichkeitsverletzungen bildet das Recht am eigenen Bild. Nur in den seltensten Fällen kennt jemand den Namen der Fotografen, allerdings ist der Bekanntheitsgrad der Bilder meist enorm.
